Yuppers. If that isn't over reacting I don't know what is.
Way to many webmasters are freaking on this right now for no reason. Wait to see what happens with the public feedback. There are already groups getting ready to counter against this in court as we speak. I also see constitutional issues arising. 2257 is already a law that has been in place for a while now. I think once all is said and done with the amendment it will turn out to be just another Bush hoax. Lets see has he found all those weapons of mass destruction yet? Webmasters should talk to an attorney before doing anything rash. I think most would say follow the rules already in place and don't worry about it for now. It will be a long drawn out battle for sure. |

Regarding the proposed rules, the comment period is over. There is now a 30 day period during which the comments will be reviewed and the proposed rules may or may not be revised. In any case, the new rules go into effect 30 days after the publication of the final rules in the Federal Register, which could happen Monday or it could happen 3 weeks from now. Nothing has gone into effect yet, and anyone claiming that the "proposed" new rules are already enforceable is being reckless and inflammatory. Seems like the guy who pulled down all his sites was definitely bitten by a doomsayer or two.
Me, I'm still building sites. The new content I buy from this day forward has all info required by the "proposed" regs, so I'll be covered regardless of what the final rules look like. I've taken some time and build myself a database that will allow me to comply. The new regs are NOT retroactive, though the waters are still muddy even with the 10th circuit ruling on who is and isn't a "primary producer" since that ruling only technically applies to the 10th circuit. So, I say better safe than sorry. By not being one of the "sky is falling" crowd, I've efficiently used the last couple months to prepare myself for whatever happens, and I know that the great majority of experienced US webmasters have done the same thing. Yes, I'm prepared for some sort of hassle once the new regs go into effect, but since they're not published in the FR yet any action such as pulling all sites down is WAY premature. You wanna panic? At least wait for the final rules to be published. |

Complete over-reaction the law isnt even in effect and some attornies just had a news article on Yahoo yesterday (Freedom of Speech Coalition I believe) and they discussed how they were fighting this stuff, so I dont see anything happening real fast, thats for sure.
