Where is it legal to film your own porn? Is Florida cool?

I live in Florida. And I've always wondered if it is totally legit for a couple to film and sell access to their sex life, etc., etc.

In what U.S. states is it legal to just up and produce a "do it all yourself" porn site?

I'm not a lawyer and don't even play one in porn but we've been producing it in Florida for years without any issues.

It would probably have a lot to do with what part of Florida you are in as far as how tolerant the community would be.

Awesome... I'm in the Gainesville area... it's a liberal community with the college 'n all... but I've never heard of porn being made here.
I've heard of some amateur-type sites where they pay women to do naked playboy-like photos occasionally, but never people just fucking in their apartment, posting it online and charging people for access. I'm not even talking about anal clownshoe porn or anything that would surprise or offend anybody per se, although I'd like to think that'd be ok too.

I figure if the State law says it's legit, then it is cool to make it anywhere in FL. But I don't know sh$t about the law. What do you think about where I'm at?

There is one county in California where porn production is legalized - no where else in the U.S. is there a law protecting its production. That's it. People do it everywhere, they simply don't flaunt the fact.

There are a couple follow-up questions though.

Do you have to start a company, or can you just do it like you would webmastering?
Does one need to hire a lawyer to be 'secure' in production?
What specific forms/contracts must women and men sign to appear in a film?
How much should an unknown person be expected to be paid if they are not the person making the 'film'.

You can add the State of New Hampshire to that list of places where the court has ruled that porn production is not prostitution. That ruling came down late in 2008.

Everywhere else, the jury is still out until a case is prosecuted and a ruling made.

You are going to need a consent form (performer's written agreement for you to display the work online, publish it, etc.). You also need copies of documents proving each performer is over 18. If it is hardcore, a medical certificate for each performer is a good idea too (but in most territories not compulsory).

There is no "standard" rate. A friend of mine who works in this business gets paid anything from the equivalent of under $100 a day to over $5000 a day, depending on who she works for.

Just a thought (and I have no idea if this is correct, but it something you should look into just in case): If you decide to take your cast and crew across a state border because of easier laws, aren't you in contravention of the Mann Act?

There was another mess a few years back when they used interstate commerce(ie. using equipment made in a different state) to try prosecuting in I think Florida.

It's hard to believe we live in the 21st century sometimes. I love how the Christian radical are going around shouting down the health care bill because, they say, it is too much government in their lives, and yet they seem to think nothing of denying people the right to make a living off the one thing that should be totally theirs -- their bodies. What utter hypocrisy. And to top it all off, it turns out that the conservative bible thumping red states are bigger porn consumers than the blue progressive states. How I HATE religion!

Of course, again, these answers spawned additional questions.
My apologies for my ignorance of the subject.

Where can you get legitimate consent forms without going to a lawyer?
How many forms of ID/documents (which ones other than D.L.) do you need to have copies of?
Do ordinary (g.p.) doctors test and give out medical certificates?
