Proadult moving off shore
If your sites are on Proadults servers and they move off shore to Panama, then is it true that you don't have to comply with 2257?
From the PA website Heres is our solution! We will be moving all the network of hosting servers that contain adult material out of the country. We have set a blueprint for this move where it will cause no downtime whatsoever. Once the redclouds machines are out of the country, no one using those machines will have to worry about the license issues. The domain hosting servers, however, once they are moved, in order to comply with this law and be on the safe side,the US webmasters will be given an option to use a corp that belongs to us in Panama as the registrant of the domain name. They will not be able to touch a single strand of hair on any webmaster using our network. We will have nothing based in the US. We have bought ourselves some time by joining a countersuit against the government for violating privacy policy issue. This case will give us leisure to make the move smooth and organized. If this is true? Then won't moving your sites off shore yourself, be just as good? I'd love some input here. Many people have sites hosted both with programs like PA or Adults Allowed. There's probably other networks too. |

The offshore move idea is a dodge, promoted by a couple of operators in Panama. I personally think that it might protect people from being in the first wave of DOJ inspections, providing they haven't already made the list.
I will say without a doubt that the DOJ is rarely impressed by attempts to use smoke and mirrors to avoid legal liability. Further, as this law effectively dates back to July 1995, they only have to ask for records for June 2004 and see what they get. I wouldn't do this without a bunch of lawyers all saying it works. Where your hosting is located is pretty much irrelevant as I read it. Your primary place of business is still wherever you call home. If that's in the US, then you're still subject to US law. You could host your site on the moon, and that wouldn't change a thing as far as 2257.

Something tell's me that Igor (Voyeurweb/Pro Adult guru) probably has pretty good lawyers. I doubt he has Dewey, Cheetum, & Howe on retainer.

Unless they're also moving their base of operations and all employees from Florida to Panama, I don't see where Igor has gained a thing in terms of 2257 by moving his servers.

there is a different sponser I use that is offering a similar situation. they are in Austrailia and are offer to host sites on thier DNS and their servers as a way to avoid this. I just emailed them to ask about this. It sounds nice, but like mentioned before even if everything is hosted offshore, I live in the US and I build and upload the website so that makes me the secondary producer and still subject to the law.

I'm pretty much in the same boat as Igor. I have thought the same thing about moving to a foreign host, getting a foreign processor, and getting a foreign bank account. Then I would not be hosting from the US, or processing, or keeping my money in the US. Fuck... I might as wells move as well!

Speaking from a hosting pov, I have seen a lot of non-US webmasters move to offshore servers and quite a few are even cutting out all US-based affiliate programs so they are totally out of the USA. I think its a smart move, you never know what the DOJ will try to do, mostly to inconvenience you and get you to move out of their country.

We are concerned since our forum allows members to post photos. Mostly it is a humor forum but people do tend to post photos that include nudity and humor.
Any suggestions or ideas as to what the other forums are doing? |
