Question, posting surfer-submissions on my site
Can someone tell me a legal way to do this? Although it primarily applies to a blog, I would like to implement this on another upcoming site, so I've posted it here.
I get a lot of emails from surfers asking if I could post their pics. Keep in mind I'm in the UK (still hosted in the U.S). In view of recent legislation can anyone advise on a way to pull it off? |

To be compliant with US 18 2257, as long as there is no sexually-explicit content, as defined in 18 US 2256 Section 2 (excluding part E and simulated), you should not need any documentation relative to US 18 2257.
Being that you are in the UK, and that is where any documents would be kept, I can see no way you'd ever be inspected anyway regardless of where your site is hosted. *Standard disclaimer applies. This is just my educated opinion. I am not a lawyer. |

I always cringe when people talk about this. Who's to say the posters are posting their own pics? Who's to say they have the legal right to post them on your blog? Or they post pics to get back at some one, or pics they stold from some one else?

Isn't this just about the same as the Reno(?) case where a swinger magazine was using submitted pictures? The DOJ lost.
Also read somewhere in all this that somebody got nailed using non-nude pics that focused on the genitals(CP). Sort of explains that category. |

Your biggest issue in reality is the liability if the person submitting isn't the person in the pictures. Maybe they got drunk at a party, or perhaps this is a pissed off ex.
