2257 effects started

Just got an email from sitepass:

...Everything from Visa regulations on processing transactions to the latest anticipated 2257 changes have created an environment that we must adapt to in order to continue to prosper and bring webmasters a wide range of programs. That being said, it is to my displeasure that I must inform all of our webmasters that as of September 1st, 2004, SitePass will be closing down for good.

I never used them but I wonder if its an indication of things to come!

I just got that e-mail too. I don't know what to do about any of this so I'm going to take the "wait and see" approach. Hopefully I'm such a small fish in this business that I can wait and see what others do then get my act together.

The new 2257 requirements are going to cause major problems for us webmasters and content providers in the UK.

Under our data protection laws we cannot give the details required by the ammendments. We could be taken to court for giving a models details to all those who may need it..

We're waiting for 24th Aug to see what happens before panicking, though I lost a potential sale of content yesterday, as I had to refuse to supply the models private details to a US based major sponsor...

I think SitePass's problems are more to do with AVSs in general and this was the final blow.

I did use them at one time. They had a nice program but not a lot of traffic.

I agree with Cleo about SitePass having problems with being an AVS in general. I used them a long time ago when they where just SitePass and did very well. When they merged with ARS, my sales/rebills practically died over night.

Had COPA gone though (and I wish it did now) -- it would have been a wet dream for an AVS company.

This is not about 2257 at all.

The UK Data Protection Act 1998.

"Where a data controller cannot comply with the request without disclosing information relating to another individual who can be identified from that information, he is not obliged to comply with the request unless-

(a) the other individual has consented to the disclosure of the information to the person making the request, or

(b) it is reasonable in all the circumstances to comply with the request without the consent of the other individual."

Consent seems like an option???

I can't get hold of some models I shot over a year ago.. They've given up modelling, moved, changed phone numbers etc.

Where would I find the new regulations? Is there a publication somewhere? My attorney has the old stuff but am wondering if I need to update any of it yet?

Jay, had COPA goen through, we would all be working at McDonalds now... because Visa and Mastercard have made it clear they have no interest in the AVS model. No law would force them to do that business, which would leave us all with no way to promote sites.

Urb: I am looking forward to see a clarification regarding content created previous to the effective date of these changes. Right now there is a total lack of implementation information, typical when someone just writes "whatever" rather than putting it through the normal law making process.
