As many of you would know I created the term Whale Tail. When I was told about www-whaletail-com I was shocked I had tried buying that domain from the Deli that was once there. guess I didn't have enough cash for their liking now Hawgs cash go and say they started the site in 2003 HAHAHAHAHA

I mean what they did is fair enough, they had enough cash I didn't. but they could at least say it was started in 2004. I bet they get a lot of typos for the site after it was in FHM and the NYTimes.

the term whale tail, something I came up with when I was drunk, in porn terms is the shape of the thong showing over the back of women's jeans when it becomes exposed.

The problem with general terms like that is that people will see them and use them to expand their own sales
Remember the time when there was no such thing as a MILF site :) and where it came from? a little mainstream movie - and now a bunch of sponsors have sites promoting them
And there are loads more terms like that - looking at the SEs the term has been used by many people in the last 18 months to promote their own stuff

totally understand why they used the term, it was just an e-mail from a fan that screamed "I can't believe you've turned into a cunt and changed your site" I was shocked and asked what was up? he realised that it wasn't the normal site due to the fact he was using a friends computer, when he checked his bookmarks at home it hadn't changed. he wrote back to tell me he was sorry lol. I would never have known otherwise.

It's probably no consolation, but I prefer your site. I think you'll also get picked up better by search engines. :)

Garv came up with an idea and themed an adult site on it before any other adult site ever showed up on a search for "whale tail"

And it's a very cool idea and theme.. Fuel Magazine did a 2 page story on it.. FHM featured it..... and no matter how good the site is, they probably wouldn't have even noticed it without the cool Original name "Whale Tail".


For anyone that doesn't know, Garv does cool quirky stuff like this all the time.. and people rip his site designs off and copy his ideas constantly.

He doesn't think he is god or owns rights to the term.... Garv told me about this earlier tonight at a xmas party... and I didn't realise how upset he was until seeing this.... most people probably agree the Hawg's have just grabbed a good opportunity and it's Garv's bad luck.. that may be so, But he isn't just whining about losing a generic search term... he has busted his nut to develop his site... including trying to buy that domain... and he has a lot more right to feel kicked in the guts by this than most of us who have had ideas or sites ripped off.


Garv, as I said earlier tonight, Bosshawg is a genuinely good guy and acts more than fairly when I've seen him in dispute with people.. he is also very approachable. From what I know of him, he would be sympathetic to your situation if he understood this was your baby and not just someone bitching about losing dollars. I know you don't expect him to do anything... and I'm not sure what he could be expected to do.. but the guy has surprised me before, so I really think it is worth giving him a chance to explain what his thinking was before trashing him or his programs. And I am also almost sure he would change that copyright date to 2004 if he knew why, and how much it mattered to you.

Anyway hopefully he will come across this thread even if you don't feel like approaching him. You are both the sort of people we need more of in our industry. So I hope you can work something out.

Garv doesnt seem to be about.. so I'll just let people know that Bosshawg did see this thread and as expected, there was nothing malicous or even slightly suspect going on.


Garv thought the domain was registered to a Deli site until 2007. He had offered them $1000 for it but they werent interested. he figured, well at least another adult site wont be able to get it either, so it's safe to keep working this dashed version of the domain. Garv assumed someone had seen all his publicity, gone to the Deli site owner and offered them more money, specifically to trade off the idea... which I can see would make you feel pretty mad in his shoes.

Anyway, what actually happened..... the domain dropped weeks ago and went into a drop domain auction. Bosshawg and another of the bigass domain market people ended up in a bidding battle for it.. not just because of the publicity garv had generated around the term and certainly not with any intention to undermine his site... without knowing the full story, no experienced domain buyer would expect a person who built a site on a dashed version of a domain had any serious branding intentions like Garv does.

I just want to point out to Garv that you are a dickhead for posting this thread, particularly when I told you last night that it was GOOD news if the Hawgs were the ones who bought it as they are the fairest big players in this biz and would do something to help you out almost for certain.


Anyway.... I said the guy had surprised me before.. but even I didnt expect this.

The copyright date is already changed as you wanted... and the domain is yours if you would like it. At the same price Bosshawg paid!

And just to blow your socks right off your feet... you can have up to 6 months to pay Bosshawg the money he has already paid out of his pocket for the domain.

Although it's not 100% good news :\ One downside of your branding success is, this domain didn't sell cheaply! ;- )
