That was the case but it is no longer true. In Canada, the term rape was eliminated in the 1980s and replaced with the term "sexual assault". At that time, references to husbands were removed from the criminal code, with respect to sex crimes. Also, the new law explicitly allowed, for the first time, women to be charged with the crime of sexual assault.
