In response to a petition filed by the Free Speech Coalition asking the 10th Circuit Court of Appeals for an injunction, that would stop the enforcement of the new 2257 regulations, the Department of Justice entered into an agreement with the lawyers representing the Free Speech Coalition. The Department of Justice agreed to delay any enforcement of the new regulations, including any investigations of any member of the Free Speech Coalition. After careful consideration, Chop Cash believes the Department of Justice is in violation of equal protection laws guaranteed by the 14th amendment of the United States Constitution by agreeing to selectively enforce who will be investigated and/or prosecuted for violations of the new 2257 regulations.

Previous court decisions have held that a valid statute may be rendered invalid as violative of equal protection if its provisions are selectively enforced. Chop's Cash feels that any investigation that leads to an arrest of any violation of the new 2257 regulations will be struck down in the courts because of the disregard and violation of the 14th amendment by Department of Justice. For this reason, Chop's Cash will not remove any promotional material, including hosted free sites and free-hosted galleries.

Anticipating the proposed changes to the 2257 regulations, Chop Cash positioned itself to remove any sexually explicit depictions, that we could not retrieve age documentation on from our content providers, should the proposed regulations be adopted.  Due to the violation of the 14th amendment by the Department of Justice, Chop's Cash has decided not to remove those depictions at this time.
